Ukraine has approved the nation’s technical regulation for the classification, labeling and packaging (CLP) of substances and mixtures

Technical Regulation : on May 15, 2024, Ukraine’s Cabinet of Ministers issued Resolution No. 539 of May 10, 2024 (Resolution 539/2024) ‘On Approval of the Technical Regulation for the Classification of Hazards, Labeling and Packaging of Chemical Products’ (the Technical Regulation).

According to Article 1(49) of the Law of Ukraine No. 2804-IX of December 2022 ‘On Ensuring Chemical Safety and Management of Chemical Products’, the term ‘chemical products’ is defined as chemical substances, mixtures, alloys and products, during the use of which there is deliberate release of chemical substances, or which are manufactured to carry out explosive works or create a pyrotechnic effect.


Ukraine’s Technical Regulation was modeled on Regulation (EC) No. 1272/2008 ‘Classification, Labeling and Packaging of Substances and Mixtures’, CLP Regulation, consolidated version to December 2023 for reference) in the European Union (EU), a piece of legislation that implements the United Nation’s Globally Harmonized System of Classification and Labeling of Chemicals (GHS).

Resolution 539/2024 also adds ‘Item 71 Chemical products’ to the list of products that are subject to market surveillance activities under Ukraine’s Cabinet of Ministers Resolution No. 1069 of December 28, 2016.

This product list contains a wide variety of goods and the name of the regulatory act to which they are obliged to comply with. These include, but are not limited to:

  • Electrical and electronic equipment (EEE) – Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 No. 139 ‘On approval of the Technical Regulation for the restriction of the use of certain hazardous substances in electrical and electronic equipment’

  • Equipment – Resolution of the Cabinet of Ministers of Ukraine dated December 16, 2015 No. 1077 ‘On Approval of the Technical Regulation for Electromagnetic Compatibility of Equipment’

  • Low-voltage electrical equipment – Resolution of the Cabinet of Ministers of Ukraine dated December 16, 2015 No. 1067 ‘On Approval of the Technical Regulation for Low-Voltage Electrical Equipment’

  • Personal protective equipment – Resolution of the Cabinet of Ministers of Ukraine dated August 21, 2019 No. 771 ‘On Approval of the Technical Regulation of Personal Protective Equipment’

  • Radio equipment – Resolution of the Cabinet of Ministers of Ukraine dated May 24, 2017 No. 355 ‘On Approval of the Technical Regulation of Radio Equipment’

  • Shoes – Order of the Ministry of Economic Development of March 6, 2019 No. 358 ‘On Approval of the Technical Regulation for the Marking of Materials Used to Manufacture the Main Components of Footwear Delivered for Sale to the Consumer’

  • Textile fibers and textile products – Order of the Ministry of Economy of July 28, 2020 No. 1408 ‘On the approval of the Technical Regulation for the names of textile fibers and related labeling and marking of the fiber composition of textile products’

  • Toys – Resolution of the Cabinet of Ministers of Ukraine dated February 28, 2018 No. 151 ‘On Approval of the Technical Regulation for the Safety of Toys’

Resolution 539/2024 will come into effect on November 15, 2024 – six months after its publication.

The following provisions will become effective on January 1, 2025:

  • Section 3 ‘Labeling chemical products with information about hazards’

  • Section 6 Clauses 130-133 ‘Authorized bodies in the field of ensuring chemical safety and management of chemical products’

Chemical products not complying with the technical regulation, but which were placed onto the market before November 15, 2024, may remain on the market until November 14, 2025.
